These Introduction & Coordination Terms (“Intro Terms”) apply when you request or receive an introduction, referral, brokerage-related coordination, or administrative support from Jet Nova Partners (“JNP”, “we”, “us”). They supplement the Website Terms and our Privacy Policy.
1) Our role (default)
Unless we sign a separate written engagement with you, JNP acts as an independent introducer and coordinator. This may include facilitating communication, arranging introductions, and coordinating logistics (e.g., viewing or inspection scheduling, basic follow-up).
For clarity, our default role is administrative coordination and introductions only. You remain responsible for selecting and engaging any third party, agreeing scope/pricing, and making all decisions.
2) Brokerage role only if agreed in writing
In some cases, JNP may act as a broker for a buyer or a seller under a separate written agreement (for example a brokerage mandate or a buyer engagement). Any exclusivity (exclusive or non-exclusive) depends on what is agreed in writing.
3) No agency unless agreed in writing
JNP is not your agent (and you are not ours) unless we agree in writing. We do not have authority to bind any party or make warranties/representations on behalf of a buyer, seller/owner, or third-party provider unless agreed in writing.
4) Buyer and seller responsibilities
You remain responsible for your own decisions and for independent verification and due diligence. This includes (without limitation) checking aircraft documents/logbooks, maintenance/airworthiness status, regulatory compliance, and obtaining independent inspections.
5) No responsibility for aircraft condition / hidden defects
Aircraft may have defects (including latent/hidden defects). JNP does not inspect, certify, or guarantee aircraft condition or airworthiness. Any information provided via listings or introductions may originate from sellers/owners or third parties and must be independently verified.
6) Third-party services (inspectors, maintenance, ferry, etc.)
Any third-party service provider (including LAME inspectors) is independent. Any contract, scope of work, pricing, advice, service quality, findings, or outcomes are between you and that provider. JNP is not liable for third-party acts or omissions to the extent permitted by law.
7) No insurance
JNP does not provide insurance. You are responsible for arranging any insurance cover you require.
8) Records and communications
To manage enquiries and coordination responsibly, we may keep internal records of requests and communications (for example, aircraft reference, dates, and basic contact details), in accordance with our Privacy Policy.
9) No guarantee / as available
The introduction and coordination support is provided on an “as is” and “as available” basis. We do not guarantee outcomes, availability of any aircraft, third-party availability, inspection findings, or that any introduction will lead to a transaction.
10) Limitation of liability (to the extent permitted by law)
To the maximum extent permitted by law, JNP is not liable for any indirect, consequential, incidental, or economic loss arising from introductions, coordination activities, reliance on third-party information, aircraft condition, or third-party services (including loss of opportunity, profit, or costs incurred such as travel or inspections).
To the extent liability cannot be excluded, JNP’s total liability is limited to the fees actually paid to JNP for the relevant service in the 30 days immediately before the event giving rise to the claim (or NZD $0 if no fees were paid).
Nothing in these Intro Terms excludes liability that cannot be excluded under applicable law.
11) Business use
If you are acquiring services from JNP for business purposes (in trade), you agree you are not relying on consumer guarantees to the maximum extent permitted by law.
12) Governing law
These Intro Terms are governed by the laws of New Zealand and disputes are subject to New Zealand courts.
