These Terms of Use (“Terms”) apply to your access to and use of this website (the “Site”). By using the Site, you agree to these Terms.
1) Definitions
- JNP means Jet Nova Partners (“we”, “us”).
- Content means all material on the Site, including listings, text, images, branding, design, and layout.
- You means any person who accesses or uses the Site.
2) About the Site
The Site provides information about aircraft and allows users to contact Jet Nova Partners. JNP may, where appropriate, facilitate introductions and/or administrative coordination between buyers and sellers/owners, and may coordinate with independent third-party service providers (including LAME inspectors). The Site is provided for information, introductions, and coordination purposes only.
3) JNP’s role (brokerage / introductions)
JNP may act as an introducer/coordinator, and in some cases may act as a broker for a buyer or a seller. Any brokerage engagement (including whether it is exclusive or non-exclusive) must be agreed in a separate written agreement.
Unless agreed in writing, JNP does not have authority to bind any party, sign on behalf of any party, or make warranties/representations on behalf of a buyer, seller/owner, or third party.
4) Site availability — “as is”
The Site and Content are provided on an “as is” and “as available” basis. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components. We may modify, suspend, or withdraw any part of the Site at any time.
5) No professional advice — due diligence required
Nothing on this Site is legal, engineering, maintenance, valuation, or airworthiness advice. You must perform your own due diligence before buying, selling, operating, or relying on any aircraft, including:
- independent pre-purchase inspection(s) by a suitably qualified person (e.g., a LAME);
- verification of logbooks, maintenance status, airworthiness, and regulatory compliance;
- arranging insurance and any required approvals.
6) Listings / information — seller-provided; not an offer
Aircraft listings and related Content may be based on information provided by sellers/owners or third parties and may change without notice. Listings are informational only and do not constitute an offer, warranty, or contract.
Prices, availability, and specifications are subject to seller confirmation and may be updated or withdrawn at any time. While we aim to present information responsibly, you must independently verify any listing information before acting on it. If you believe a listing is inaccurate, please contact us.
7) Introductions and third-party services
JNP may facilitate introductions between buyers and sellers/owners and/or between clients and independent service providers (including LAME inspectors).
Unless expressly agreed in writing:
- we are not the seller, buyer, owner, operator, maintainer, or certifier of any aircraft;
- we do not provide insurance and do not guarantee aircraft condition, airworthiness, pricing, availability, or outcomes;
- any inspection, advice, work, or services provided by third parties are between you and that provider.
8) Third-party links and platforms
The Site may reference or link to third-party websites or platforms (for example external listings or media). These are not controlled by JNP. We are not responsible for third-party content, availability, policies, or actions.
9) Acceptable use
You agree not to:
- misuse the Site, interfere with forms/functions, or attempt unauthorised access (including to private data);
- submit false or misleading information;
- use the Site to harass, defame, or violate others’ rights.
10) Intellectual property, limited licence, and anti-scraping
All Content on this Site (including branding, logos, text, layout, and design) is owned by or licensed to JNP and is protected by intellectual property laws.
Limited licence: we grant you a personal, non-exclusive, non-transferable, revocable licence to access and view the Site for your own personal or internal business evaluation purposes.
Except as permitted by law, you must not, without our prior written consent:
- copy, reproduce, republish, mirror, distribute, or commercialise any part of the Site;
- extract, scrape, harvest, or index listings, images, contact details, or other Content (whether manually or by automated means);
- use our branding or Content in a way that suggests endorsement or affiliation.
You may share links to pages on the Site, provided you do not misrepresent the Content or your relationship with JNP.
11) Right to refuse, suspend, or remove
We may refuse or restrict access to the Site, and remove or refuse to display content or enquiries, where we reasonably consider it necessary (including for safety, legal compliance, suspected abuse, or spam).
12) Privacy
Your use of the Site is also governed by our Privacy Policy.
13) Consumer law (New Zealand)
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under New Zealand law that cannot be excluded. Where you are acquiring services for business purposes (and not as a consumer), you agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by law.
14) Limitation of liability (to the extent permitted by law)
To the maximum extent permitted by law, JNP excludes liability for indirect or consequential loss, loss of profit, business interruption, or loss of opportunity arising from your use of the Site, reliance on Content, or any introduction.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15) Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless JNP from any claim, loss, liability, cost, or expense (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Site, or information you submit that is false, misleading, unlawful, or infringes another person’s rights.
16) Changes
We may update the Site or these Terms from time to time. Continued use means you accept the updated Terms.
17) Governing law and disputes
These Terms are governed by the laws of New Zealand and disputes are subject to New Zealand courts. Before commencing formal proceedings, the parties will first attempt to resolve any dispute in good faith through discussion.
